Welcome to the One Million Masterpiece, a project website (the “Website”) operated by The One Million Masterpiece Ltd (the “Company”, “We”, “Our”), a non-profit making company limited by guarantee and registered in England .

In visiting this Website (“Website Visitor”) or by becoming a member of the One Million Masterpiece project (“Project Member”) you agree to be bound by the Terms and Conditions as in effect at the time of your visit. The General Terms and Conditions below apply to both Website Visitors and Project Members. Further specific Terms and Conditions exist for both Website Visitors and Project Members. Please read them all carefully.

PRIVACY

The One Million Masterpiece Ltd is committed to protect your privacy and maintain any personal information received from you in a safe and secure manner. We strictly adhere to the requirements of the data protection legislation in the UK .

You have the right to see the personal information registered about you upon request. If the information is inaccurate, incomplete or irrelevant, you have the right to request that the information be corrected or deleted.

We follow strict security procedures in the storage and disclosure of information which you have given us, to prevent unauthorised access in accordance with the UK data protection legislation.

We will not transfer your information outside the EEA (European Economic Area) without first obtaining your consent.

All content included on this Website is the property of The One Million Masterpiece Ltd or its corporate partners, and is protected by international copyright laws. All content on the Website that is not the property of The One Million Masterpiece Ltd is used with permission. All software applications used on this site are the property of The One Million Masterpiece Ltd.

If you believe that an image or picture displayed or used in any way on the Website constitutes copyright or trademark infringement, please report the offending image using the ‘Report to Moderator' facility giving a brief description of your concerns and your contact details. Alternatively, write to us at the address below making sure that you include the offending image ID (number), artist's name, and your full contact details.

CHANGES TO TERMS & CONDITIONS

The One Million Masterpiece Ltd will make every effort to ensure that the Website is available continuously, but reserves the right to modify, suspend or discontinue all or any part at any time with or without notice. Unless specifically exempted, any new features, services or software applications introduced shall be subject to these Terms and Conditions. The One Million Masterpiece Ltd reserves the right to modify or replace these Terms and Conditions at any time. Any change shall be effective immediately as it appears on the site. Each time you use the Website you are deemed to have accepted any such change.

FAILURE TO COMPLY

In the event that you commit a breach of these Terms and Conditions The One Million Masterpiece Ltd reserves the right at its sole discretion to immediately and without notice suspend or permanently deny your access to all or part of the Website. Your account will be deleted and your image ID re-allocated to a new user. By breaching these Terms and Conditions you surrender all rights to a refund of your donation.

TERMINATION

You may discontinue use of the Website at any time. These Terms and Conditions will continue to apply to past use by you.

LIMITATION OF LIABILITY

In no circumstances will The One Million Masterpiece Ltd be liable for any loss or damages, whether direct or consequential arising out of (i) your use of the Website or your inability to do so (ii) your reliance on any content and/or (iii) goods and services in any way associated with the Website.

These Terms of Service are governed by English law.

The following conditions are applicable to the Website visitors in addition to the General Terms and Conditions above

PRIVACY

When you view our Website we do not collect any personal information that could identify you. Our server collects generic information about your pathway through our site and assigns it to your IP address. This information is used to analyse general patterns of Website use. We do not identify individuals using this information.

If you complete an online feedback form or contact us via email we might ask that you provide your name and email address. This information is held in a database. We will only use this address to provide feedback on your specific enquiry. We might also use this address to invite you to join the Project and keep you informed of specific Project events, however your address will not be added to this list without obtaining your consent.

PROJECT MEMBERS

The following conditions are applicable to the project Members in addition to the General Terms and Conditions above

PRIVACY

We will not send you email newsletters at any time unless you have expressly opted in to receive them. All newsletters from the Project include the option to unsubscribe. You can change your contact preferences at any time by visiting the section entitled ‘My Details'.

When you provide a friend's email address when using Our “Tell a Friend” or “eCard” services we guarantee that we will only use your friend's address for this purpose. We will not send them further emails unless they opt in to receive regular information from us.

GUINNESS WORLD RECORD

The Project aims to break the World Record for “Most artists for the same artwork”. As a member of the Project you are undertaking to break this record.

It is a stipulation of Guinness World Records that all participants attempting to break this record read the following conditions:

All artists must register before contributing to the artwork. An accurate method of counting the artists must be pre-approved by Guinness World Records
The type of picture and the subject matter of the overall artwork are irrelevant to the record although it should be of a single theme
The final overall image of the artwork must be suitably recognisable when viewed in its entirety. This is at the discretion of Guinness World Records.
There is no time limit.
Any medium can be used to create the artwork.
What art materials are allotted to participating artists and how they are allotted must be pre-approved by Guinness World Records.
Connecting multiple canvases or similar is acceptable.
The creation of the artwork may take place in multiple venues, but must be displayed in its entirety for 24 hours in a single location.
Good quality, colour photos of the artwork must be submitted.

All images and pictures produced by the software applications (“Software”) on this Website are the property of the individual artist. By using our Software to create an image or picture on our servers you agree to allow The One Million Masterpiece Ltd to display, print, reprint, copy, distribute, sell, licence or otherwise market that image or picture now or at any point in the future.

YOUR ACCOUNT

As a Project Member you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. The One Million Masterpiece Ltd reserve the right to refuse service, terminate accounts, and remove or edit content in their sole discretion.

USE OF FORUMS AND MESSAGE SERVICES

You agree not to use the site community forums (“Forums”) or private messaging system (“Message Service”) to convey, or otherwise make available in any manner, content (i) that is unlawful, harmful, obscene, hateful, threatening, abusive, defamatory, harassing, libellous, invasive of another's privacy, or is otherwise objectionable, (ii) that infringes the intellectual property rights of any party or (iii) which contains a chain letter or constitutes any form of mass mailing.

The One Million Masterpiece Ltd reserves the right to edit content in any way. You represent and warrant that you possess all necessary rights to use the content that you submit to this site and that use of such content does not violate these Terms and Conditions. You agree to defend, indemnify, and hold The One Million Masterpiece Ltd harmless from and against any and all claims arising out of or relating to any content that you submit to this Website.

You agree to that the Forums and Message Service shall be used only for non-commercial use. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead any other user.

USING IMAGE CREATION SOFTWARE

The image creation Software is intended solely for the purposes of participation in this project. The Software is designed for participants aged 18 and above who can form legally binding contracts under applicable law, or by minors who have obtained the express consent of a parent, guardian or other responsible adult who can form such a legally binding contract on their behalf. By accepting this Agreement and using the Software, you acknowledge that you are age 18 or above, or that you have obtained such consent.

You acknowledge that you are solely responsible for the Images created by the Software (the “Image”) in your account, be they pictorial or text based, and you agree to defend, indemnify, and hold The One Million Masterpiece Ltd harmless from and against any and all claims arising out of or relating to any content that you submit to this site. Images created that depict or transmit a message which can be construed as (i) pornographic, obscene, indecent or of an “adult” sexual nature; (ii) violate or infringe upon the rights of any third party; (iii) be libellous; (iv) advocate or promote violence or conduct that constitutes a criminal offence; (v) promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or otherwise; (vi) be harmful to children; (vii) give rise to a civil liability or (viii) otherwise be illegal are not permitted. Such Images will be removed without warning at the sole discretion of The One Million Masterpiece Ltd. Recognising the global scope of the Internet, you further agree to comply with all applicable laws regarding the transmission of electronic data exported from the country in which you reside.

You agree not to upload, post or otherwise transmit any content that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware including the Software and the Website.

You agree to create a picture using the Software within 30 days from the date of your signup. If an image has not been created after this 30 days period The One Million Masterpiece Ltd reserves the right to delete your account and re-allocate your ID to a new user.
